De invoering van Het Nieuwe Werken gaat meestal niet onopgemerkt voorbij aan een ondernemingsraad (or). Met welke onderwerpen moet een ondernemingsraad rekening houden als het gaat om Het Nieuwe Werken?

De ondernemingsraad heeft bijzondere bevoegdheden die invloed op het beleid van de werkgever mogelijk maken. Deze bevoegdheden - het adviesrecht en het instemmingsrecht - zijn vastgelegd in de Wet op de ondernemingsraden (WOR).

Adviesrecht
De ondernemingsraad heeft op basis van artikel 25 lid 1 WOR een adviesrecht over de volgende voor Het Nieuwe Werken relevante onderwerpen:

• belangrijke wijziging van de werkzaamheden van de onderneming;
• belangrijke wijziging in de organisatie van de onderneming;
• wijziging respectievelijk invoering of wijziging van een belangrijke technologische voorziening (vaak is hiervan sprake in geval van telewerken).
  

Ook is bepaald dat bij het vragen van advies aan de ondernemingsraad een overzicht wordt verstrekt van de beweegredenen van het besluit en een overzicht van de gevolgen die het besluit zal hebben voor de in de onderneming werkzame personen.

Ook de overige leden van artikel 25 WOR zijn van toepassing. De ondernemingsraad heeft ook adviesrecht over de uitvoering van het besluit. Besluiten met een experimenteel karakter zijn niet adviesplichtig, proefprojecten die zijn gericht op uiteindelijke realisering van een technologische voorziening wel.

Instemmingsrecht
In artikel 27 lid 1 WOR zijn de onderwerpen genoemd die instemming behoeven van de ondernemingsraad. Het gaat daarbij bijvoorbeeld om:

• werktijden;
• arbeidsomstandigheden;
• ziekteverzuim/re-integratiebeleid;
• personeelsbeoordeling;
• werkoverleg;
• verwerken/beschermen van persoonsgegevens;
• waarneming van of controle op aanwezigheid, gedrag of prestaties.
