Is de werkgever aansprakelijk voor de thuiswerkplek?

Het zijn vragen die door veel door werkgevers worden gesteld. Ben ik verantwoordelijk voor de thuiswerkplek of flexibele werkplek van mijn werknemers? En ben ik aansprakelijk als de werknemer hierdoor schade lijdt?

Terechte vragen, zo blijkt. Een werkgever, een grote pensioenuitvoeringsorganisatie, ondervond al in 2006  de 'pijn' van onvoorbereid beginnen aan thuiswerken, zonder over de (vergaande) consequenties op het gebied van een goede inrichting van de werkplek en aansprakelijkheid na te denken.

Een werkneemster die gedurende negen maanden bij de werkgever werkzaam was geweest, was tijdens de arbeidsovereenkomst met klachten aan beide armen uitgevallen. Er werd vastgesteld dat het Repetitive Strain Injury (RSI) betrof.

De werkneemster was zowel werkzaam geweest op kantoor als op de plek waar zij gedetacheerd was, en bovendien  thuis (twee dagen per week). De werkneemster heeft de werkgever aansprakelijk gesteld voor de schade voortvloeiend uit het feit dat de werkgever niet had 'gezorgd' voor de veiligheid van de werkomgeving ( de 'zorgplicht' als genoemd in artikel 7:658 Burgerlijk Wetboek).

Zorgplicht geldt ook voor werkplek thuis
De werkgever voerde aan dat hij niet verantwoordelijk was voor de werkplek waar de werkneemster gedetacheerd was en vond dat eveneens ten aanzien van de thuiswerkplek. De kantonrechter en ook het gerechtshof in kwestie oordeelden dat de werkgever aansprakelijk was,  en vond dat de werkgever niet goed had gezorgd voor de inrichting van de werkplekken.

Belangrijk daarbij is dat de zorgplicht van de werkgever in dit geval ook gold voor de werkplek thuis en de gebouwen buiten het kantoor van de werkgever, omdat die de werkneemster had gedetacheerd en de werkneemster daarnaast toestemming had gegeven om thuis werkzaamheden te verrichten en een computer ter beschikking had gekregen.

Uit deze uitspraak kan worden afgeleid dat wanneer er zeggenschap is over de werkplek, de zorgplicht van de werkgever tot de thuiswerkplek en de 'detacheerwerkplek' reikt. Een zware dobber voor deze werkgever. En reden temeer om na te denken over de (juridische) consequenties van Het Nieuwe Werken, nu er hierdoor nog meer thuisgewerkt zal worden en dit thuiswerken onderdeel zal uitmaken van een goed doordachte strategie van de werkgever.

Werkgever moet voldoen arboregelgeving
Een van de verplichtingen waaraan de werkgever ten minste moet voldoen in het kader van zijn zorgplicht is neergelegd in de normen uit de arboregelgeving (Arbeidsomstandighedenwet, Arbeidsomstandighedenbesluit en Arbeidsomstandighedenregeling).

Zo is het verboden om thuiswerk te laten verrichten met gevaarlijke stoffen, draagt de werkgever zorg voor installatie en onderhoud van (elektrische) werktuigen en machines, en dient hij zo nodig bepaald meubilair te verstrekken om een 'ergonomisch verantwoorde werkplek' te creëren. Deze verplichtingen gelden net zo goed voor thuiswerk.

Verwijzen naar eigen verantwoordelijkheid zinloos
Interessant was overigens dat de werkgever nog had aangevoerd dat de werkneemster, gelet op haar leeftijd en opleidingsniveau, zelf een taak had de werkgever te wijzen op de gebrekkige inrichting van de werkplekken.

Het gerechtshof wees er echter op dat schending van de zorgplicht door de werkgever van groter gewicht was dan het nalaten van de werknemer. Ook de poging om te verwijzen naar de eigen verantwoordelijkheid van de werknemer, die onder Het Nieuwe Werken alleen maar zal toenemen, strandde dus in het geval van de werkgever.

Of de in het vorige artikel gesignaleerde toename van de verantwoordelijkheid van de werknemer ertoe zal leiden dat er minder snel tot aansprakelijkheid van de werkgever zal worden gekomen, is dus nog maar de vraag. Dankzij Het Nieuwe Werken zou hierin geleidelijk een verschuiving kunnen plaatsvinden.

Regelgeving is te star of bevat hiaten
Is er voor thuiswerkers nog enig houvast ten aanzien van de zorgplicht te vinden in de arboregelgeving, dan is dat niet het geval voor de werknemers met flexibele werkplekken. De regelgeving is te star of vertoont juist hiaten, blijkt in de praktijk.

In de regelgeving is bijvoorbeeld niet voorzien in normen voor mobiele werkplekken. Denk daarbij aan werken in de trein of op andere 'mobiele' locaties, zoals speciale werkplekken gecreëerd langs de snelweg. Daarnaast gelden de regels voor beeldschermwerk niet voor de 'mobiele devices', terwijl inmiddels van de iPhone, iPad en diverse smartphones veelvuldig gebruik wordt gemaakt.

Niet ondenkbeeldig is het geval van de werknemer die als gevolg van het zakelijk gebruik van de iPhone RSI krijgt en zijn werkgever daarvoor aanspreekt. De werkgever zou daarvoor aansprakelijk kunnen zijn.

Onderwerp zal steeds vaker aan de orde komen
Dergelijke kwesties zullen onder Het Nieuwe Werken steeds vaker aan de orde komen. En dan lijkt het niet waarschijnlijk dat de hiaten in de arboregelgeving de werkgever zullen ontslaan van zijn verantwoordelijkheid en mogelijke aansprakelijkheid voor de 'Nieuwe Flexibele Werkplek'.

In lijn met bovengenoemd voorbeeld zou de werkgever in ieder geval zeggenschap moeten hebben over de werkplek om tot aansprakelijkheid te kunnen komen, maar zeker is dit niet. De tijd zal het leren.

Mogelijk zal de werkgever zich in de toekomst wel kunnen verzekeren tegen schade die is ontstaan bij ongelukken op de thuiswerkplek of de flexibele werkplek. En ook al is in de politiek inmiddels doorgedrongen dat de arboregelgeving aan verandering toe is, voorlopig zullen we het nog moeten doen met de huidige arboregelgeving als 'ondergrens' voor de zorgplicht van de werkgever.

Schade en aansprakelijkheid zo veel mogelijk inperken
Aan de andere kant: wanneer de  (thuis)werkplek op ergonomisch verantwoorde wijze is ingericht en de werkgever voldoet aan de overige arbonormen, dan zou de werkgever weinig te vrezen moeten hebben qua aansprakelijkheid.

De volgende instrumenten kunnen de kans op schade en aansprakelijkheid zo veel mogelijk inperken:

• een telewerkovereenkomst waarin duidelijke afspraken worden gemaakt met de werknemer over de werkplekken;
• controle van de (thuis)werkplek door de arbodienst;
• terbeschikkingstelling van meubilair voor de werkplek;
• voorlichting over verantwoord ergonomisch werken en beeldschermwerk.
  

Deze instrumenten zijn noodzakelijk voor bedrijven die aan de slag gaan met Het Nieuwe Werken. Werkgevers, wees voorbereid!
