Arbeidsrechtadvocaten Michaël van Basten Batenburg en Emmie Koppens bekijken Het Nieuwe Werken door een juridische bril. Aan de hand van een uitspraak van de kantonrechter laten ze zien dat het 'oude' arbeidsrecht niet klaar is voor Het Nieuwe Werken.

In talloze publicaties valt te lezen over Het Nieuwe Werken, de nieuwste rage in managementland. De juichende toon van de boeken die verschijnen doet vermoeden dat het gaat om een slim vermarkt product dat aan de man gebracht moeten worden.

Immers, het Nieuwe Werken is vooral nieuw en hip, en schijnbaar onontkoombaar. Bedrijven die er niet aan meedoen staan stil, zullen achteroplopen en uiteindelijk op de fles gaan, zo profeteren de pleitbezorgers van Het Nieuwe Werken.

Het Nieuwe Werken neemt een grote vlucht
Het Nieuwe Werken is echter verre van nieuw. De eerste voorzichtige schreden dateren al van de jaren negentig van de vorige eeuw. Sinds de komst van nieuwe ICT-mogelijkheden, mobiel internet en innoverende communicatieapparatuur als de iPad neemt Het Nieuwe Werken echter een grote vlucht.

Thuiswerken is nooit makkelijker geweest en inmiddels wordt er gewerkt in het openbaar vervoer, tijdens het tv-kijken of waar dan ook. Je kunt je afvragen of dat een gezonde ontwikkeling is, maar een feit is dat het voor je ogen gebeurt.

Juridische hindernissen bestaan wel degelijk
De hoeveelheid boeken, artikelen, workshops en weblogs over Het Nieuwe Werken is overweldigend informatief. Des te opvallender is de stilte rondom de juridische dimensie, terwijl er wel degelijk juridische hindernissen bestaan. Die zullen eerst overwonnen moeten worden.

Onneembaar zijn deze hindernissen echter niet. Ze zijn vooral gekoppeld aan het 'oude' arbeidsrecht, dat spijtig genoeg niet klaar is voor Het Nieuwe Werken. Wettelijke regels kunnen door enthousiaste werkgevers echter niet zonder meer worden genegeerd. Alle reden dus om Het Nieuwe Werken eens tegen het licht te houden vanuit een juridische invalshoek.

Vooral tijd- en plaatsonafhankelijk werken
Het Nieuwe Werken is voornamelijk een begrip dat tijd- en plaatsonafhankelijk werken betreft. Direct opvallende juridische raakvlakken betreffen de inrichting van de werkplek, arboregels en werktijden.

Vragen die rijzen, hebben te maken met de scheidslijn tussen werk en privé, en het spanningsveld van controle enerzijds en vertrouwen anderzijds. Ook andere, niet minder complexe onderwerpen spelen een rol van betekenis:

• de (al dan niet stilzwijgende) wijziging van de arbeidsovereenkomst;
• de beoordelingssystematiek;
• de invulling van de begrippen goed werkgeverschap en goed werknemerschap;
• de fiscale problematiek;
• de aansprakelijkheid van de werkgever bij een arbeidsongeval.

Hierbij liggen er voor werkgevers grote uitdagingen in het verschiet om de regelgeving binnen de organisatie 'HNW-proof' te maken. Daarvoor is nader inzicht nodig in wat er op beide partijen gaat afkomen.

De wetgever loopt - zoals altijd - achter bij de maatschappelijke ontwikkelingen, dus zal er de komende jaren een rol zijn weggelegd voor de rechter bij het beoordelen van juridische vragen over Het Nieuwe Werken.

Voorbeeld: werknemer vordert achterstallig salaris
Een voorbeeld van zo’n zaak is die van de kantonrechter Haarlem, waarvan de uitspraak dateert van 13 januari 2011 (LJN BP1395). In die zaak vorderde een werknemer achterstallig salaris, waarop de werkgever zich verweerde door aan te voeren dat de werknemer in een bepaalde maand niet had gewerkt. Er werd zelfs een tegenvordering ingediend tegen de werknemer, omdat hij in een andere maand ook niet had gewerkt.

De kantonrechter oordeelde in het nadeel van de werkgever, aangezien partijen bij het aangaan van het dienstverband ervan waren uitgegaan dat de werknemer 'zo veel mogelijk zelf zijn dienstverband zou invullen', maar de werknemer niet de plicht had zelf voor werk te zorgen.

Kern van de zaak was het feit dat de werknemer gedurende enige tijd wat minder te doen had en vervolgens een tijdje thuis op de bank bleef zitten. De werkgever verweet de werknemer daarom een 'passieve houding'.

De werkgever vond dat het op diens weg lag om zelf werk te gaan zoeken, gelet op de grote vrijheid die Het Nieuwe Werken hem bood. De rechter sloot echter aan bij een criterium uit een arrest van de Hoge Raad uit 1972 (NJ 1973, 60) en vond dat de passiviteit van de werknemer een risico was van de werkgever.

Huidig recht staat Nieuwe Werker in de weg
Dit is een mooi voorbeeld van het huidig recht dat in de weg staat aan het ideaal van de moderne, 'nieuwe' werknemer. Werkgevers die aan Het Nieuwe Werken willen beginnen, zouden voorlopig dan ook moeten letten op de bepalingen in de af te sluiten arbeidsovereenkomsten met hun werknemers. Dan gaat het in het bijzonder om de verplichtingen van de werknemer, die aanzienlijk scherper moeten worden geformuleerd.

Bovendien zal de werkgever andere controle-instrumenten moeten gaan hanteren om te voorkomen dat hij niet weet of een werknemer iets te doen heeft. Immers, een groot deel van de werktijd kan de werkgever zijn werknemers niet observeren.

De wijze van beoordeling van een prestatie, en de daaraan verbonden gevolgen, zullen ook ingrijpend gaan veranderen.

Verantwoordelijkheid tussen werkgever en werknemer verschuift
De belangrijkste tendens lijkt toch wel te zijn dat de verantwoordelijkheid tussen werkgever en werknemer verschuift, evenredig aan het gegeven vertrouwen. Goed werknemerschap vraagt erom dat een werknemer die vertrouwen krijgt, dat niet mag beschamen.

Dit is het eerste deel uit een serie over de juridische aspecten van Het Nieuwe Werken. In de komende artikelen zal aandacht besteed worden aan andere onderwerpen die door Het Nieuwe Werken in de schijnwerpers komen te staan.
